1.Làm gì khi bị dừng xe?
-Hỏi người dừng xe với mục đích gì?
1. Kiểm tra hành chính
2. Thông báo lỗi:
– Yêu cầu chứng minh lỗi
– Đọc thần chú “ yêu cầu anh lập đúng lỗi vi phạm như anh vừa thông báo”
KHÔNG CHUYỂN LỖI NHẸ HƠN VÌ NHIỀU KHI BỊ LỪA, MÌNH KHÔNG PHẠM LỖI. GẠ CHUYỂN LỖI LÀ LÀ BIẾT BIÊN BẢN CHO ĐỦ CHỈ TIÊU.
2.Không đồng ý với lỗi được thông báo thì làm gì?
-Yêu cầu CS chứng minh lỗi của mình
-Chứng minh mình KHÔNG vi phạm
-Ghi vào biên bản ý kiến của mình: không đồng ý
-Trường hợp không được ghi ý kiến : gọi điện lên cục CSGT trình bày, khiếu nại

3.Lỗi nào lập biên bản , ra quyết định, xé biên lai tại chỗ
-Cá nhân dưới 250k, tổ chức 500k.
-Trường hợp lập biên bản giữ giấy tờ với lỗi 250k không xé biên lai: Ghi vào biên bản người lập biên bản không có biên lai.=> KHIẾU NẠI VỀ HÀNH VI SÁCH NHIỄU NHÂN DÂN, RA ĐƯỜNG KHI KHÔNG ĐỦ GIẤY TỜ QUYỀN HẠN.
4.Lập biên bản sai lỗi vi phạm, giữ giấy tờ mà không lập biên bản thì phải làm sao?
Gọi điện CS 113 & Cục CSGT phản ánh hành vi . Cục CSGT( 069.234.2608)

5. Lỗi gì với vạch tim đường?
– Vạch tim đường PHẢI là màu vàng 1.1, 1.2, 1.3, 1.4. Vạch màu trắng KHÔNG phải là vạch tim đường, hoặc dùng sai chức năng => không có giá trị.
– Khi đè vạch, lấn làn với vạch tim đường liền nét thì CHỈ CÓ LỖI SAI VẠCH. Xe máy 70k, oto 150k.
Đi hẳn sang bên kia vạch vàng liền tim đường là lỗi không đi về bên phải. Mức phạt ngang với đường cấm.
6.Báo lỗi tốc độ nhưng chưa có hình ảnh chứng minh
Ghi vào biên bản là CS lập bb nhưng chưa có hình ảnh.
Kiểm tra ảnh:
1.Có tốc độ xe ( bắn ở phía sau phải có dấu “-”)
2.Có dấu chấm xác định xe của mình hay không?
3.Có điểm giằng ( ngoại cảnh để đối chiếu) xem có đúng là bị bắn ở đoạn đường quy định hay không?
4.Ảnh đúng là xe vi phạm?
5.Có thấy rõ biển số không? Nhiều khi trời tối xxx bắn tốc độ ảnh đen xì mà cũng lôi ra làm bằng chứng
LƯU Ý: HÌNH ẢNH KHÔNG RÕ BIỂN SỐ XE MÌNH THÌ KHÔNG CÔNG NHẬN
( nhỡ có 5 xe giống nhau đi cạnh nhau, xe bị bắn là xe khác không phải xe mình)
7.Lỗi nào cần chứng minh bằng hình ảnh?
1. Tốc độ( bắt buộc)
2. Nồng độ cồn ( bắt buộc giấy in từ máy đo)
3. Đè vạch, lấn làn
4. Vượt đèn đỏ
5. Vượt phải
8.Đi thẳng , đè vạch mắt võng là lỗi gì?
Không có lỗi, vạch mắt võng chỉ cấm dừng.
Với vạch mắt võng CHỈ CÓ LỖI SAI VẠCH, KHÔNG CÓ SAI LÀN
Vạch mắt võng chuẩn không có vạch chồng vạch khi kết hợp với mũi tên rẽ phải sẽ thành BẮT BUỘC PHẢI RẼ PHẢI.

9.Quên xi nhan qua vòng xuyến, đường cong lỗi phạt bao nhiêu?
Không có quy định chế tài nào để phạt, yêu cầu lập đúng biên bản với lỗi xi nhan qua vòng xuyến, đường cong.
Luật chỉ yêu cầu PHẢI có tín hiệu khi báo rẽ, báo chuyển làn.
11. 2 người ngồi trên xe không đội mũ bảo hiểm phạt 300k có phải ra kho bạc?
Luật quy định xử phạt người điều khiển, người ngồi trên xe không đội mũ bảo hiểm : mỗi ông 1 biên bản, 1 QĐXP
12. Xe 1.4T có được vào đường cấm xe tải?
Xe 1.5T trở lên mới là xe tải. Xe dưới 1.5T là xe con.
13. Bị lập BB mà không ưu tiên giữ bằng lái mà giữ đăng kiểm có được không?
Thứ tự giữ giấy tờ Bằng-> Đăng ký -> Đăng kiểm. Giữ sai theo thứ tự này thì xxx đã vi phạm. => viết đơn khiếu nại
14. Quên bằng lái với không có bằng lái làm sao để chứng minh?
Nhận QĐXP xuất trình bằng lái sẽ chuyển thành quên .
Bảo hiểm không có = quên.
15. 1 xxx tuần tra ,lập biên bản có được không?
1 chốt tuần tra kiểm soát tối thiểu 2 người, 1 người không đủ thẩm quyền dừng xe.
Biên bản lập chỉ có 1 người ghi tên lập vẫn được.
16. Vi phạm giao thông được đưa về phường thì phải làm sao?
Nếu không phải là hành vi gây nguy hiểm như đua xe, đánh võng( hình sự)… thì hành vi vi phạm hành chính thông thường không đủ cơ sở để đưa về.
Điều 122. Tạm giữ người theo thủ tục hành chính.
1. Việc tạm giữ người theo thủ tục hành chính chỉ được áp dụng trong trường hợp cần ngăn chặn, đình chỉ ngay những hành vi gây rối trật tự công cộng, gây thương tích cho người khác.”
Nếu không đua xe đánh võng, đá lửa, bốc đầu… thì không có lý do gì để bị tạm giữ cả, nên cũng ko bị áp giải về phường.
17. Biên bản chuẩn như nào?
Có số quyển, số biên bản, dấu treo của đơn vị cấp.
Biên bản không đủ chuẩn theo mẫu thường không có dấu treo tròn của đơn vị cấp.
=> khiếu nại về việc lập biên bản không chuẩn, không có giá trị pháp lý.

18. Rẽ ở nơi cấm rẽ thì phạt bao nhiêu?
Biển đúng quy chuẩn PHẢI có biển hướng dẫn 418 đặt trước biển cấm rẽ.
Biển đặt bên phải chiều đi, đặt trên cột đúng quy định ( nhiều trường hợp đặt trên cột điện, gốc cây là sai quy chuẩn-> biển không có hiệu lực)
Mức phạt xe máy 70k, oto 150k
19.Vượt đèn vàng bị ghi biên bản không chấp hành hiệu lệnh tín hiệu giao thông phạt bao nhiêu?
Yêu cầu ghi rõ biên bản là “ không chấp hành đèn tín hiệu giao thông: đèn vàng’’
Không có lỗi, đèn vàng là cảm tính của người dừng xe.
QC41: Đèn vàng: Cảm thấy nguy hiểm thì vượt qua đèn vàng, vượt qua nơi giao nhau. XXX không ngồi trên xe nên không biết tình huống có nguy hiểm hay không.
=> ĐÈN VÀNG KHÔNG CÓ LỖI
20.Phân biệt lỗi sai làn, sai biển báo& vạch kẻ đường đơn giản
A.Sai làn: Đi sai làn được phép đi, vạch chuẩn, biển 412 chuẩn. Đi vào làn xe thô sơ có vạch sơn theo quy định của làn xe thô sơ.
Sai vạch: đè vạch liền màu trắng 2.2 hoặc vạch vàng 1.2 hoặc đi không đúng theo hướng của vạch mũi tên 9.3.
B.Khi nào xảy ra sai làn?
Sai làn xảy ra khi đi sai làn đường quy định của phương tiện tham gia giao thông. VD oto đi làn xe máy, làn xe thô sơ
Điều kiện xảy ra sai làn:
1.Đường có biển 412 theo quy chuẩn, treo trên giá long môn hoặc cột cần vươn
2. Có các vạch 2.3 trắng liền.
3. Trường hợp đi vào làn đường thô sơ có kết hợp biển dành cho xe thô sơ và vạch kẻ đường trắng liền, sơn chữ hoặc hình xe đạp
Lưu ý: các trường hợp KHÔNG hội tụ đủ 2 điều kiện 1 và 2 trên thì KHÔNG XẢY RA SAI LÀN
21.Đi như trường hợp 1, 2, 3 có lỗi gì? Sai làn?
NẾU CHỈ CÓ CÁC VẠCH NHƯ HÌNH HOẶC KHÔNG CÓ BIỂN 412 PHÂN LÀN THÌ:Sai vạch kẻ đường, biển báo . Xe máy 70k, oto 150k
22.Như nào là biển báo chuẩn?
QC41.2016
20.1 Biển báo đặt tại vị trí người giao thông dễ nhìn thấy
20.2 Biển đặt đứng, bên phía tay phải
24.1 Cột biển báo kích thước đường kính tối thiểu 8cm
22.1 Tại nơi đô thị biển có thể đặt lên cột điện, kiến trúc vĩnh cữu( cảm tính vì nhỡ cột điện đổ thì biển mất, không có tác dụng)
38.3 Tại nơi giao nhau, biển hiệu lệnh phải được nhắc lại. Nếu không có biển nhắc lại biển hiệu lệnh mặc nhiên hết hiệu lực
Các biển cấm đơn giản như cấm dừng đỗ, cấm xe oto, cấm rẽ có kích thước: ĐƯỜNG VIỀN TRÒN GẤP ĐÔI ĐƯỜNG GẠCH CHÉO( tỉ lệ viền: chéo = 2:1)
23. Đè vạch xương cá – vạch kênh hóa có vi phạm?
CÓ : lỗi đè vạch. Xe máy 70k, oto 150k.
24. Em dừng đèn đỏ và 1 nửa xe trước vạch dừng (7.1),đè vạch dừng. xxx lập biên bản em lỗi vượt đèn đỏ có đúng không?
Hiệu lệnh QC41 vạch 7.1 không có cấm đè.
Hiệu lệnh đèn đỏ: phải dừng trước vạch dừng hoặc cột đèn. Đèn hiệu lệnh cao hơn vạch.
=> Vượt đèn đỏ. Giam bằng 2 tháng
